The approval of the Law Marco
surrounded the law of Supervision of Services Public (Sisep),
the creative law of the Institute of the Urban and Rural
Reformed Property (Iprur), the law of Social Security and
the constitutional reform to article 138, numeral four, of
the Political Constitution of Nicaragua, that reduced
attributions to the Executive authority to name ministers,
vice-ministers and diplomatic body.
In the case of the Nicaraguan
Institute of Energía (INE), the Law Marco allowed to
president Enrique Bolaños to propose a short list to occupy
the direction of that institution, nevertheless, the
deputies decided to name the liberal David Castillo.
Decreased attributions of the
president
Although the proposal of
Montealegre tries to give back the institucionalidad to the
different powers from State, in the end, the deputies of the
National Assembly will have to ratify the appointments of
the government cabinet who carries out the sandinista Daniel
Ortega.
Article 30, interjection 33, of
the Statutory law of the National Assembly, authorizes the
deputies “to ratify the appointment made by the President
from the Republic the ministers, vice-ministers of State,
Solicitor and General Assistant attorney general of the
Republic, head of diplomatic missions and presidents or
directors of independent and governmental beings”.
In addition, he himself article
30, in its interjection number four of the Statutory law,
authorizes the deputies “to ask for information to the
ministers and vice-ministers of State, Solicitor, General
Assistant attorney general of Justice, presidents or
directors of independent and governmental beings that will
have the inescapable obligation to render them”.
He himself interjection four
allows that the deputies “also will be able to require the
personal appearance and interpellation (of the civil
employees of the government). The appearance will be
obligatory, under such pressures that are observed in the
judicial procedure. The injustificada appearance will not be
causal of destitution”.
Montealegre said that it is not
certain that with the prorogation of the Law Marco “it
leaves to the free hands to the President and ministers”,
since all the reforms are congealed.
It added that during the year that
is suspended the Law Marco, “we opened the opportunity to
initiate a process of deep reforms to the Constitution”.
Prorogation favors to the
sandinista Front
Nevertheless, the large stone
bench of Partido Liberal Constitucionalista (PLC) from
already announced that the Sandinista Front will endorse the
prorogation to the Law Marco.
“Obvious that yes (will endorse
it), because this does a favor to him to Daniel Ortega,
because with the constitutional reforms the Gentleman
President of the Republic had to come here and to request to
the National Assembly the ratification to him of ministers”,
maintained the head of large stone bench of the PLC,
Maximino Rodriguez, the Statutory law establishes that they
must be ratified by the Assembly.
The board of directors of the
parliament created a special commission that the sandinista
will preside over Edwin Castro and who will have to consider
in the course of this week the project of prorogation of the
ALN.
In a session programmed for
Tuesday, the deputies will send the prorogation initiative,
to the special commission, that in addition to Castro
integrates the Wálmaro sandinista Gutiérrez; the deputies by
the PLC, Wilfredo Navarro and Maximino Rodriguez; the
representatives by the ALN, Jorge Matamoros and Eduardo
Go'mez; in addition to Juan Ramon Jiménez, elect under the
flag of Sandinista the Renovador Movement (MRS).
The head of large stone bench by
the PLC, Rodriguez, announced that they will maintain his
opposition to the initiative of the ALN, large stone bench
to which accused “to agree” with the FSLN to prorogue the
Law Marco.
The FSLN still resists to announce
their position around the approval of a prorogation to Law
Marco.
“I do not want to give personal
opinion, our large stone bench meets the next week”,
indicated Castro.
The female leader of large stone
bench by the ALN, Maria Eugenia Sequeira, rejected that they
have negotiated beforehand with the FSLN.
BOLAÑOS SIGNED REQUEST
On the other hand, ex- president
Enrique Bolaños, signed the request of a prorogation,
according to Rodriguez, to pay “the favor to him” to Ortega,
when now the agent chief executive proposed in a 2005 Law
Marco.
“That is a negotiation in hot,
that they did and in addition it is a favor that Bolaños to
Mr. Ortega is paying to him to Mr. Enrique, because at his
moment she came to speak of a Law Marco so that Bolaños
followed until his last days naming his ministers”, said
Rodriguez.
Montealegre assured that its
parliamentary large stone bench will present/display a
series of reforms that will contribute to the
institucionalidad of Nicaragua.
